 Tanzania’s Prime Minister Urges Swift Action on Justice Commission’s Recommendations

On May 6th, 2024, Prime Minister Kassim Majaliwa issued a clarion call to regional commissioners, urging them to spearhead the implementation of vital recommendations from the Criminal Justice Commission.

In a compelling address, he emphasized the imperative for government leaders and officials to possess profound comprehension, essential for the successful oversight and execution of these recommendations.

These remarks were made during a workshop aimed at enhancing the understanding of regional commissioners and regional secretaries on improvements in the criminal justice system and dispensation of justice in the country.

The Prime Minister stated that citizen complaints on various issues prompted President Samia Suluhu Hassan to establish the Criminal Justice Commission and accept its recommendations, ultimately transforming it into a committee to develop strategies for implementing the Commission's recommendations.

 Grievances included conflicts between local by-laws and national laws, such as the imposition of taxes by local councils, leading to confusion among citizens as they are held accountable by multiple authorities.

He also highlighted other issues, including land disputes, misuse of arrest powers, and the practice of regional and district commissioners accompanying security committee members on unnecessary tours, causing fear among citizens and hindering them from expressing their concerns to these leaders.

"As representatives of the President in your respective areas of administration, it is your duty to ensure that his vision is realized by overseeing and implementing all recommendations made by the Criminal Justice Commission," he stressed.

He emphasized the need for government leaders and officials to have sufficient understanding to supervise and implement these recommendations effectively.

He also called on regional leaders to consider the establishment of necessary infrastructure for criminal justice institutions in newly established administrative areas.

Meanwhile, Deputy Minister in the Office of the President – Regional Administration and Local Government, Dr. Festo Dugange, stated that they would oversee the implementation of instructions and directives given at the workshop to fulfill the President's commitment to ensuring that citizens access their rights.

On the other hand, the Chairperson of the Commission, Retired Chief Justice Mohamed Othman Chande, mentioned that their committee was formed to work on a report with 333 recommendations for improving the performance of criminal justice institutions in various areas.

He noted that crime rates in the country were increasing annually, with significant efforts directed towards combating rather than detecting and preventing crime.

"One of our tasks in this committee is to develop a national strategy for detecting and preventing anticipated crime, which will serve as a tool for implementing all relevant institutions and authorities to combat crime in the country," he said.

The Criminal Justice Commission in Tanzania was established to address growing concerns over crime and ensure the effective functioning of justice institutions. With a mandate to review existing practices and propose reforms, the Commission aims to enhance the efficiency and fairness of the criminal justice system.

The Justice Commission's report revealed alarming trends in crime rates across Tanzania, with a notable increase in various criminal activities year by year. The report highlighted deficiencies in the criminal justice system, including gaps in law enforcement, inefficiencies in prosecution, and challenges in preventing crime effectively. As well, it sheds light on systemic issues such as corruption, inadequate resources, and insufficient training for law enforcement personnel.

Additionally, the report emphasized the need for a holistic approach to tackling crime, advocating for collaboration among government agencies, law enforcement bodies, and legal experts. It highlighted the importance of implementing comprehensive strategies that prioritize preventive measures and community engagement.

In response to these findings, the Justice Commission proposed a series of recommendations aimed at strengthening the criminal justice system and addressing underlying issues contributing to crime. These recommendations include reforms in legislation, improvements in law enforcement practices, enhanced training for personnel, and measures to promote transparency and accountability.

By implementing these recommendations, the Commission aims to create safer communities and uphold the rule of law in Tanzania. Through concerted efforts and a commitment to reform, the Commission strives to restore public trust in the justice system and ensure that all citizens can live free from fear of crime.

In the wake of the Justice Commission's report, Tanzania stands at a pivotal moment, poised to confront crime head-on and fortify its justice system. With unwavering collaboration and resolute determination, the nation can surmount these challenges and forge a future where safety and justice prevail for every citizen.
